Everyone knew it would only be a matter of time before Lindsay Lohan would be back in jail.
The troubled actress was arrested again on November 29th, 2012 for punching Tiffany Ava Mitchell, a 28-year-old Florida psychic, unexpectedly the face around 4 am. The women were inside a nightclub in Manhattan’s Chelsea neighborhood named ‘Avenue’ when it happened. Lohan had actually been previously banned from the club but had been let back in for the night.
“I need space,” Lohan allegedly said right before she struck the psychics face with her fist. It appears that Mitchell had offered to give Lohan a free psychic reading in the VIP section of Avenue.
When police finally caught up to Lohan, they asked her about her June 8th, 2012 car accident and she denied that she was the driver. Lohan’s black Porsche had run into the back of a dump truck while on the Pacific Coast Highway in California. Police knew she was the driver and since she denied it, they accused her of lying.
This all happened after they caught Lohan, since her and her crew had tried to escape the nightclub before she could be stopped by police for punching the psychic.
Lohan tried to slip out the back door of the nightclub and ran into an alley that leads to W. 17th St where her car and driver were waiting for her, but Mitchell saw her running away and pointed her out to the police.
“That’s her,” Mitchell told the police. Lohan was already sitting in the front passenger seat of a black Cadillac Escalade about to drive off when she was identified.
As soon as Mitchell pointed her out, the police blocked Lohan’s car with their cars and stifled her chance to speed off. Onlookers said that 26-year-old Lohan looked shocked when the police tossed handcuffs on her.
According to TMZ.com all she kept saying was “Are you kidding me? Are you kidding me?” Lohan was charged with misdemeanor assault and was released but is scheduled for a court hearing on January 7th, 2013.
Following the incident, the Santa Monica police department added three other misdemeanor counts of their own. One of them is “lying to an officer”, another is “obstructing an officer in the course of his duties”, and the last one they added is “reckless driving”.
Lohan has already been incarcerated five times, but only for short periods of time. This latest incident could lead her to serve jail time once again.
It is up to a judge in California to decide if Lohan breached her probation rules by either allegedly lying to the police about the car wreck in California or by the attack on Mitchell in New York.
Lohan is already on probation due to her pleading guilty to theft. Back in 2011 Lohan was at a jewelry store in Venice Beach named Kamofie & Co. when she put a $2,500 necklace on her neck and walked out of the store with it. She pleaded guilty to this and was put on probation.
Even though Lohan has been in jail several times, she was always released shortly after being arrested due to overcrowding. She has never served more than a matter of hours in there.
The night of the assault, Lohan was taken to the 10th precinct stationhouse in her same clubbing attire. She called her attorney with her one phone call that she was allowed. Her attorney, Mark Jay Heller, didn’t waste any time in defending her and making excuses for her behavior.
“Once again, Lindsay Lohan is a victim of someone trying to capture their 15 minutes of fame,” said Heller. He also declared later that Lohan was not intoxicated when she assaulted Mitchell.
“I can tell when I was with her this morning she was in great condition,” he told E! News. “She was certainly not intoxicated, certainly not under the influence of drugs.”
Mitchell’s husband, 37-year-old Wayne Stevens, was with her when she was assaulted. He states that Lohan started the attack on his wife for no reason, and then tried to run away before the NYPD showed up. Mitchell and her husband were sitting with a different couple when they heard a fight break out at a table near them.
According to the police, Mitchell moved away from the fight as soon as it started, so that she wouldn’t be in the way and get hurt. However, she accidently wandered into Lohan’s path.
The police report states that Lohan was enraged because Max George, the singer of a boy band named The Wanted, was ignoring her, and was paying attention to Mitchell instead.
Mitchell’s husband feels that Lohan had absolutely no reason to attack his wife, and just did it without just cause. Lohan basically shoved Mitchell from behind, and then delivered a single blow to the left side of her face.
“She pushed my wife pretty hard, and I don’t know why (Lohan) pushed her,” he said. “She comes around and told my wife, ‘I need space”… and then she just punched her.”
TMZ states that after Lohan shoved and punched Mitchell, Mitchell volunteered to give Lohan a free psychic reading but Lohan just ignored her. She instead turned around to walk the other way and referred to Mitchell as “a f—ing Gypsy.”
Mitchell’s husband immediately called the police after the attack and as Lohan was scrambling to leave the club. Lohan had a busy night that night; she had just gone to Madison Square Garden for a Justin Bieber concert before she went to the nightclub, then she was at the nightclub where she caused all the commotion, after the nightclub incident she was taken to jail, and was later seen leaving the jail with a coat over her head to shield her from the paparazzi that had gathered.
This is not the first time she has caused trouble at Avenue nightclub. As mentioned before, she had been banned from club before by management because of tweeting negative remarks and gossip about Justin Timberlake one night when they were both in the club.
Michael Lohan, her father, told the Daily News Confidenti@l, via text, that he was not surprised that Lindsey was arrested; he then proceeded to blame Dina, Lindsey’s mother and his ex-wife, for Lindsay’s behavior.
“Again, it’s ALL on Dina,” he wrote to them.
“She is in a dark place. It’s in God’s hands and I hope he deals with her appropriately,” he continued.
Just hours after Lohan’s newest attack, Dina released a statement to the public about the situation.
“As a mother, you always love and pray for the best with all your children. Our family’s bond grows deeper and stronger during the tough times.”
Aside from her charges in California and New York, Lohan is dealing with several other personal problems. In September, Lindsey had a fight with a congressional aide, and in October, her and her mother had a major blowout where they even called the police on each other to name a few.
Lohan has had a long history of drug and alcohol abuse and has had a hard time staying clean and sober. She was court ordered to stay at the Betty Ford Center for rehab at one point, but was released in January of 2011 and has not been back since then.
